Reservation: RBE No.230/1987 – SC/ST

Sub:  Reservation for SC/ST posts of Instructors, Lecturers, Vigilance Inspectors etc. filled up on tenure basis -Recommendation of the Parliamentary Committee on the Welfare of SC/STs (8th Lok Sabha) (1986-87) on the implementation of reservation rules for SCs/STs on Western Railway.

Recommendation No.2 made by the Parliamentary Committee on the Welfare of SCs/STs (8th Lok Sabha) (1986-87) in their 23rd report is reproduced below:

“The Committee are shocked to learn that there are only six per cent posts for Sch. Castes among Instructors, four per cent among Lecturers and nine per cent posts among Vigilance Inspectors in Western Railway.

The picture is still gloomier in case of Sch. Tribes who have no representation at all in any of these posts. The Committee cannot but conclude from this that the instructions issued by the Deptt. of Personnel & Administrative Reforms in their O.M. No.36012/7/77 Estt.(SCT), dated 21st Jan., 1978 which lay stress on the fair proportion of such posts being filled by employees belonging to Sch. Castes/ Sch.

Tribes have not been implemented by the Western Railway in the spirit behind them.

The Committee, therefore, recommended that while requesting other Departments to sponsor candidates and selecting persons therefrom for posts to be filled by deputation or transfer in the Railways, the instructions issued by the Deptt. of Pesonnel and Administrative Reforms in this regard should be strictly followed in letter and spirit.”

The extant orders of the Government vide Board’s letters quoted above provide that in respect of posts like those of Instructors, Lecturers, Vigilance Inspectors etc. which are filled on tenure basis on deputation.

Whenever it is proposed to depute a railway servant in public interest to a post in or under another department etc., SCs/STs Railway employees who are eligible should also be considered along with other eligible employees for such deputation. The same policy should be followed when it is proposed to obtain on Railway on deputation, staff from any other Department/ Ministry. Where the number of vacancies to be filled on Railways by deputation is fairly substantial, endeavor should be made to fill a fair proportion of vacancies by SC/ST employees.

The Ministry of Railways desire that the existing instructions on the subject as contained in Board’s letters noted above should be followed strictly in letter and spirit and that a fair proportion of vacancies in such posts on the Railways as are mentioned above should be filled up by the SC/ST employees unless suitable person from amongst them is not available.
