Missing Railway Employees: RBE No.36/1988 – Clarifications

Sub: Grant of settlement dues to eligible family members of Railway employees who have suddenly disappeared and whose whereabouts are not known – Clarifications thereon.

1. In terms of this Ministry’s letter of even number dated 19.09.1986, the procedure for regulating settlement dues etc., to eligible members of Railway employees who have suddenly disappeared and whose whereabouts are not known have been laid down. Certain doubts in regard to the implementation of the aforesaid orders were expressed by the Railways. The matter has been considered in consultation with the Department of Pension and Pensioners’ Welfare. The points raised and the clarifications thereon are indicated below:

(i) Whether the Deposit Linked Insurance can also be paid No
(ii) The date of effect of the Board’s orders dated 19.09.1986 The orders take effect from 29.08.1986.
(iii) Whether past unsettled cases prior to the date of effect (i.e., 29.08.1986) of Board’s orders dated 19.09.1986 can be considered. Yes. But the payment of dues in such cases will be regulated as indicated in para 2(IV).
(iv) The mode of regulating the payment of salary, Family Pension/ DCRG etc. in the past cases. In case the formalities stipulated in para 3(i) of the aforesaid order dared 19.09.1986 were fulfilled at the material time i.e., before the issue of orders, then subject to fulfillment of conditions stipulated in para 3(ii) of the above order; the cases may be regulated as under:
(i) Payment of salary, P.F., leave encashment etc. those indicated at item (i) of para 2 of the Board orders dated 19.09.1986, may be made immediately.
(ii) The Family Pension/ DCRG etc; i.e. those indicated in item (II) of para 2 of the orders dated 19.09.1986 may be paid after the period of one year from the date of disappearance or from 29.08.1986 i.e. the effective date of orders dated 19.09.1986, whichever is later.
The period of one year will be counted from the date the F.I.R. is lodged with the police regarding the disappearance of the Railway servant.
