Pension: RBE No.09/1988 – Emoluments pre 01.01.1986 & post Retirees

Sub: Revision of provisions regulating pension in pursuance of Government’s decisions on the recommendations of the Fourth Central Pay Commission and grant of pensionary benefits to temporary Railway servants.
1. Apropos this Ministry’s letters of even number dated 15.04.1987 (RBE No.90/1987) and 06.10.1987 (RBE No.247/1987) on the above mentioned subject, representations have been received that emoluments drawn during pre 01.01.1986 period reckoned for calculation of 10 monthly average should be governed by pre 01.01.1986 definition of emoluments, since the revised definition of emoluments takes effect from 01.01.1986.
The matter has been carefully considered in consultation with Department of Expenditure and Department of Pension and Pensioners’ Welfare and it has been decided to accept the suggestion. In partial modification of paragraph 9 of this Ministry’s letter of even number dated 15.04.1987 (RBE No.90/1987) read with letter dated 06.10.1987 (RBE No.247/1987), referred to above.
The President is pleased to decide that in the case of employees retiring within 10 months from 01.01.1986, in whose case a part of the period prior to 01.01.1986 is reckoned with for calculation of average emoluments, the emoluments drawn during pre 01.01.1986 period will include besides basic pay, the special pay, personal pay etc., as defined in Rule 2003(21)(FR-9(21))R.II together with D.A., ALA., Ad hoc D.A. and Interim Relief admissible thereon actually drawn by the retiring employee.
2. Enquiries have also been made regarding the interpretation of the expression ‘death in harness’ occurring in paragraph 7.2 of this Ministry’s letter dated 15.04.1987 (RBE No.90/1987), referred to above. It is hereby clarified that the intention is to interpret it as “death while in service” in the same way as used in Para 703 of the Manual of Railway Pension Rules, 1950.
