RBE No.96/1985 Fixation of Pay – Ex-Combatant Clerks

Sub: Fixation of pay of ex-combatant clerks/ storemen retired/ released from service in the Armed Forces on re-employment as LDCs/ Jr. Clerks/ Storemen, on the Railway.

1.     Reference Board’s letters No.E(NG)II 63 RE1-22, dated 25.07.1963, 01.04.1967, 07.11.1968, 19.01.1970 and their letter No.E(NG)II 83 RE1-22, dated 19.11.1970 on the above subject.

2.     In letter dated 19.11.1970, ex-Combatant Clerks re-employed as LDCs/ Jr. Clerks on Railways were given the option to get their pay re-fixed with effect from 1stJanuary, 1956 or from the date of their appointment, as the case may be, whichever later. The option was to be exercised within 6 months from the date of issue of that letter and the option once exercised was to be final.

3.     In has, however, been found in some cases that the option orders were not specifically brought to the notice of the individuals concerned, which has resulted in their not opting for either set of orders for their pay fixation within the prescribed time limit. To obviate the difficulties in this regard, the Ministry of Railways have now decided that in future at the time of re-employment of an ex. Combatant Clerk/ Storeman on the Railways, a reference to the different orders concerning pay fixation should be made in the letter of offer itself. A specific mention that the person to be appointed has to exercise the said option within three months of his re-employment and that such an option once exercised will be treated as final, should also be made in the said offer.

4.     This issues with the concurrence of the Finance Directorate of the Ministry of Railways.
