Voluntary Retirement: RBE No.91/1988 – Extraordinary Leave during Notice Period

Sub: Scheme of Voluntary Retirement.
1. In accordance with the instructions contained in para (2) of Board’s letter No.E(P&A)I-77/RT-46, dated 22.08.1985 (RBE No.239/1985), a Railway servant giving a notice of voluntary retirement under the Voluntary Retirement Scheme, is not permitted to avail of extraordinary leave during the Notice period.
2. A question has arisen whether an employee, who is continually sick or involved in an accident or is otherwise compelled to remain on extraordinary leave for a prolonged spell, after exhausting all the leave available, and has also not been medically de-categorised/ incapacitated, should be permitted to retire voluntarily or not, under the Voluntary Retirement Scheme (1977), if he so desires.
3. The matter has been examined in consultation with Department of Personnel and Training. In such cases, it is open to the employee to give a Notice of voluntary retirement, if he/she so desires, and simultaneously seek curtailment of both the notice period in full as well as the unexpired portion of extraordinary leave sanctioned to him/her, which may be accepted and he/she may be retired from service with effect from the afternoon of the date on which the notice is served.
4. The Board, however, desire to clarify that the instructions contained in their letter of 22.08.1985 (RBE No.239/1985), referred to above, and the clarifications herein will not be applicable to cases of premature retirement under the provisions of Rule 2046-R.II and para 620 of the Manual of Pension Rules.
5. This has the concurrence of the Finance Directorate of the Ministry of Railways.
